Terms of Service

1. Acceptance of Terms

By engaging Pixelberry's services or using this website, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our services.

2. Services

Pixelberry provides web design, development, branding, and digital consulting services. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate project agreement or proposal signed by both parties.

3. Payment Terms

  • A 50% deposit is required before project work begins
  • Remaining balance is due upon project completion before final delivery
  • Invoices unpaid after 14 days are subject to a 1.5% monthly late fee
  • All prices are in USD unless otherwise stated

4. Revisions & Scope

Each project includes a defined number of revision rounds as specified in the project agreement. Requests beyond the agreed scope will be quoted separately. Additional work is billed at our standard hourly rate.

5. Intellectual Property

Upon receipt of full payment, all final deliverables and custom design assets created for your project are transferred to you. Pixelberry retains the right to display the work in our portfolio unless otherwise agreed in writing.

All third-party assets (fonts, stock images, plugins) used in your project are subject to their respective licenses. It is your responsibility to maintain valid licenses after project handoff.

6. Client Responsibilities

You agree to:

  • Provide accurate project requirements and feedback in a timely manner
  • Supply all necessary content, assets, and access credentials
  • Review and approve deliverables within the agreed timeline
  • Ensure content provided does not infringe third-party rights

7. Cancellation

Either party may terminate a project with 14 days written notice. Work completed up to the cancellation date will be invoiced at the agreed rate. The initial deposit is non-refundable.

8. Limitation of Liability

Pixelberry's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question. We are not liable for indirect, incidental, or consequential damages.

9. Governing Law

These terms are governed by the laws of the State of Arizona, United States. Any disputes shall be resolved through binding arbitration in Maricopa County, Arizona.
